Many English people will remember signing their Deeds, (Escritura),
\nof their property at the Notary.  <\/span>Spanish
\nNotaries are officials of the state and have extensive experience and
\nknowledge.<\/p>\n

<\/o:p><\/p>\n

<\/o:p>Sometimes they ask a couple about their \u201cmatrimonial regime\u201d
\nand this can cause confusion with English and British nationals who are not
\naware of the concept.<\/o:p><\/p>\n

<\/o:p>This is because it is a civil law concept familiar to the
\nrest of <\/st1:place>Europe but not applied in English common law or
\nmatrimonial law.  <\/span> <\/span>In Spain the couple can elect to hold their assets separately or as \u201cgananciales\u201d,
\nCommunity of Property.  <\/span>The default or
\ncommon regime is gananciales.<\/o:p>\n<\/p>\n

<\/o:p>For example, a husband or wife may have a property purchased
\nafter marriage but registered in their own personal name rather than
\njointly.  <\/span>Where this property is the
\nmatrimonial home and the marriage has been a long one, the <\/st1:address><\/st1:street>English
\nCourt would take it into consideration when
\ntalking about a division of assets. This brings the English regime on divorce
\ncloser to that of Community of Property or gananciales where assets acquired
\nduring marriage are divided 50\/50,<\/o:p>\n<\/p>\n

<\/o:p>Similarly a pre-nuptial contract, generally signed before a
\nNotary, is considered as binding in <\/st1:place><\/st1:country-region>Spain.  <\/span>In English law it is one of the factors taken
\ninto account on divorce but can be overturned depending on the individual
\ncircumstances.<\/p>\n
