An unfortunate<br \/>\nconsequence of this is that when they eventually pass away, the next of kin,<br \/>\nwhether here in Spain or back in the UK are confronted with dealing with the<br \/>\nfuneral arrangements and the inheritance matters. This can seem overwhelming at<br \/>\nwhat is already a difficult time. <\/p>\n<p style=\"text-align: center;\">\n<a class=\"asset-img-link\" href=\"http:\/\/decottamckennaysantafe.typepad.com\/.a\/6a010536f0d59b970c019aff50f04b970c-pi\" style=\"display: inline;\"><img decoding=\"async\" alt=\"De Cotta Law Legal Services for foreigners in Spain\" border=\"0\" class=\"asset  asset-image at-xid-6a010536f0d59b970c019aff50f04b970c image-full\" src=\"http:\/\/decottamckennaysantafe.typepad.com\/.a\/6a010536f0d59b970c019aff50f04b970c-800wi\" title=\"De Cotta Law Legal Services for foreigners in Spain\" \/><\/a><\/p>\n<p>Following the death of a British national<br \/>\nin Spain, the next of kin, or a formally appointed representative, must decide<br \/>\nwhether to repatriate the deceased to the UK, or carry out a local burial or<br \/>\ncremation. If the deceased was covered by insurance, the next of kin must<br \/>\ncontact the insurance company without delay. If there is no insurance cover,<br \/>\nthe family will have to meet the cost of repatriation or burial.<\/p>\n<p>The death certificate, is issued by the<br \/>\nCivil Registry (Registro Civil) at the Court Building (Juzgado) or at the<br \/>\nJustice of the Peace (Juzgado de Paz). You should request as many copies as you<br \/>\nneed. The funeral director will normally assist with this. The death can then<br \/>\nbe registered with your local British Consular office. <\/p>\n<p>If the circumstances of the death were not<br \/>\nunusual, registration of the death is permitted and the body will be released<br \/>\nfor repatriation or burial within a few hours. Under a strict interpretation of<br \/>\nSpanish law, burials should take place within 72 hours of death. However, in<br \/>\nthe case of foreign nationals, the authorities will normally allow as much time<br \/>\nas necessary, although this should not be longer than a few days.<\/p>\n<p>Cremation is now widely accepted in Spain<br \/>\nand there are modern, well-equipped crematoria, except in rural areas. Ashes<br \/>\ncan also be taken back to the UK by next of kin with minimal bureaucracy. If<br \/>\nthis is not possible, local undertakers will be able to arrange the necessary<br \/>\npaperwork and transportation.
