How many times have we asked ourselves the
\nfollowing question: If I own some land in the countryside, why am I not allowed
\nto build what I choose on this land?<\/o:p><\/span><\/p>\n

 <\/o:p>The explanation to this question is provided
\nfor in the Legislation de la Comunidad
\nAut\u00f3noma de Andaluc\u00eda. <\/em>This helps detail what is possible when it comes to building in the Spanish countryside (building in the Spanish campo). <\/o:p><\/span><\/p>\n

<\/o:p>Fundamentally, the object of this legislation
\nis to ensure the continued sustainable and united development of urban areas which
\nare socially economic, cultural and already have basic facilities like roads,
\nwater and electricity in place, and to protect the areas of countryside to guarantee
\na better way of life in Andalusia. The Comunidad
\nAut\u00f3noma de Andaluc\u00eda<\/em> wants to avoid the growth of widely-dispersed
\nproperties in the countryside where basic services like roads, water and
\nelectricity are not available, and where the cost of installing these services
\nis too great. Obviously it is more practical to improve upon or maintain services
\nwithin an already established urban area.<\/o:p><\/span><\/p>\n

<\/o:p>Consequently, this limits the type of construction
\npermitted in non urban areas (known locally as the \u201ccampo\u201d). Principally, this
\ntype of land is limited to agricultural use, the keeping of livestock, forestation,
\nand for the use of hunting. <\/o:p><\/span><\/p>\n

<\/o:p>Subsequently any construction of property must
\nbe linked to the above-mentioned uses and prior to carrying out any form of
\nconstruction (ie barns, stables, storehouses) the appropriate licences or
\nauthorisations must be obtained from the relevant authorities. In order to be
\ngranted authorisation you must validate the necessary use\/construction.<\/o:p><\/span><\/p>\n

<\/o:p>On these non-urban areas, land cannot be
\nsegregated unless it is to be designated for agricultural use, the keeping of
\nlivestock, forestation, hunting, or that which fulfils the current law\u2019s
\nlimitations.  <\/span>These limitations can vary
\ndepending on the type of land, whether it will be irrigated or not, or it can
\ndepend on the local area where the land is situated.<\/o:p><\/span><\/p>\n

<\/o:p>In addition to the above, the law allows a main
\nfarmhouse or family dwelling to be constructed in these areas. However in order
\nto construct such a dwelling, it must fall within the following stipulations:<\/o:p><\/span><\/p>\n

–        
\n<\/span><\/span><\/span>The
\nland on which it is built must be used for agricultural use, forestation or for
\nthe keeping of livestock. You are required to prepare a \u201cProyecto de Actuaci\u00f3n<\/em>\u201d validating said use and proving that you
\nhave sufficient land required to undertake such activity. <\/o:p><\/span><\/p>\n

–        
\n<\/span><\/span><\/span>There
\nwill be a maximum build size within which the property must remain. You would
\nnot be permitted to build a property to any size or height that you desire.<\/o:p><\/span><\/p>\n

–        
\n<\/span><\/span><\/span>You
\nmust also prove that your profession will be in association with one of the
\nabove activities, ie that you are a farmer and that you will be able to run and
\nmaintain such a profession. You must also be registered as a resident with the
\nlocal Town Hall.<\/o:p><\/span><\/p>\n

Other types of permitted activities on this
\ntype of land are the conservation or renovation of existing buildings or
\nruins.  <\/span>The renovation of these types of
\nbuildings is somewhat limited, however not prohibited. <\/o:p><\/span><\/p>\n

Lastly, further permitted are any constructions
\nor works that are of public interest, ie the implementation of infrastructures
\nor services (roads, petrol stations or prisons etc) or temporary buildings of
\npublic interest such as restaurants or rural hotels. <\/o:p><\/span><\/p>\n

In conclusion, the legislations that the ayuntamientos <\/em>(Towns Halls) have in
\nplace to regularise the types of activities allowed in the campo<\/em> are to ensure the preservation of the natural areas, avoid
\nthe formation of widely-dispersed areas of population in the countryside and to
\nsecure the possibility of infrastructure and areas of public interest.<\/o:p><\/span><\/p>\n

Any persons who own land in the campo<\/em> and who wish to construct or
\nrenovate a property must obtain the necessary licences from the authorities and
\nthey must be able to prove that their planned activity is in connection with
\nagricultural use, forestation or the keeping of livestock.  <\/span>As you can see, there are many restrictions
\nin place and the circumstances are very limited.
