\npension sharing and pension splitting orders are now common where a couple
\ndivorce after a lengthy marriage.  <\/span>In
\nEnglish law a pension can be considered as one of the most important assets as
\nit can provide for future needs of the parties.<\/o:p><\/p>\n

<\/o:p>In the Spanish Courts when an English couple divorce,
\nEnglish law is normally applied to the financial measures.<\/o:p><\/p>\n

<\/o:p>There is generally a 50\/50 split of the assets once the children\u2019s
\nneeds have been taken care of.<\/o:p><\/p>\n

<\/o:p>It is important to provide information on pensions to your
\nlawyers and often it is necessary to find out what rights, if any, a divorcing
\nspouse will have before making an application to the Court.  <\/span>This may involve establishing the terms of the
\npension in respect of divorce and it may be necessary to contact the Pension
\nCompany.<\/o:p><\/p>\n

<\/o:p>When considering the split of assets between a couple, the
\nCourt should also look at domestic contribution to a lengthy marriage.  <\/span>An older woman or man who has not worked is
\noften worried that their contribution will not be recognized.  <\/span>It is also surprising how often one party is
\nin a much stronger position economically i.e. having other assets or
\ninvestments in their sole name.  <\/span>A good
\nway of dealing with these disparities is negotiating a financial settlement to
\nprevent a lengthy contentious divorce proceeding.<\/o:p><\/p>\n
